No finding of misconduct was made and the defendant conducted herself cooperatively and reasonably in relation to the proceedings; accordingly the circumstances did not justify a personal or indemnity costs award against the defendant and the appropriate order was scale costs on a 2B basis to be met from the estate, with the defendant's reasonable costs of defence also to be met from the estate.
