Because one trustee had materially breached duties, the trustees could not act unanimously and the trust’s sole asset faced imminent and material risk of loss or contamination, the Court had to remove both individual trustees, appoint an independent corporate trustee and vest the Oratia property in that trustee to protect trust assets and enable remedial action and sale.
