Applicants established an arguable caveatable interest in the 5 October 2004 contract because the contract had been reinstated and had not been validly avoided under the contract's conditions regime; accordingly the caveat should not lapse but the court will preserve it only on condition that applicants file and diligently prosecute specific performance proceedings by a fixed date to prevent indefinite restraint on title.
