Applying an objective/global assessment of the shuttle negotiation at mediation, the court found Mrs Simmons had authority and, in the presence of her advisers and the mediator, indicated acceptance of settlement on $180,000 inclusive of GST with defendant to pay mediator's fees; the requirement for signature was formalisation only and did not prevent a binding oral agreement; therefore the plaintiffs' claims against the defendant were settled and extinguished.
