Exchange of solicitors' letters of 18-19 July 2007 constituted a binding settlement agreement for sale of the entire property at $1,080,000; Mr Belcher had actual and, at minimum, ostensible authority to bind the defendant; privileged documents were admissible in the circumstances because the defendant put large volumes of privileged material into evidence (waiver/discretion under Evidence Act) and the contract complied with Contracts Enforcement Act s2 through an authorised agent; accordingly specific performance was granted.
