Section 29 of the Overseas Investment Act 2005 gives the vendor (party not required to obtain consent) an absolute right to cancel by written notice and confines the Court to the relief available under s9 Contractual Remedies Act; s9(5) prevents the Court from making orders that would deprive a third party purchaser who acquired in good faith and for valuable consideration, therefore cancellation was effective, the plaintiff's caveatable interest was extinguished and the caveat must lapse.
