There was a serious issue to be tried as to the lawfulness of the suspension under clause 8.5 and the power under that clause is vested in the company rather than the managing director acting unilaterally; the balance of convenience favoured reinstating Mr Singh's airport access because exclusion was financially prejudicial, therefore the court ordered reinstatement of access pending further order and declined to grant the broad prohibitory relief sought against the respondent sending notices.
