Following settlement of a sale the vendor loses the right to continue proceedings commenced before settlement under a lease covenant absent a contrary intention that is mutual or endorsed by the assignee; s 233(1) and s 234(1)(b) make the assignee the only person entitled to exercise those rights after settlement and Thistle failed to demonstrate a mutual contrary intention.
