The parenting order exception is confined to communications that directly relate to the care or contact of the children; a text solely about divorce did not fall within that exception and was not an objectively reasonable excuse for contravening the protection order, so the District Court conviction and sentence were lawful and must be upheld.

The High Court found no error in the District Court Judge's assessment of discounts and the overall sentence was not manifestly excessive; the appeal against sentence and against the imposition of the protection order was dismissed and the sentences and protection order were affirmed.

The dishonest use offending occurred in March 2015 and formed part of offending dealt with at sentencing on 29 June 2015; therefore the correct approach under s 85 was to treat the later-filed dishonest use charge as if it had been before the court in June 2015, and the Crown did not establish that additional imprisonment would have been imposed then; accordingly the seven month sentence imposed in December 2015 for dishonest use was quashed while the conviction was preserved and the offender discharged on that offending.
