The Associate Judge had jurisdiction to hear and determine the strike-out application because s26J(4) was intended to exclude judicial review under the Judicature Amendment Act and the supervisory prerogative remedies, not all declarations in civil or NZBORA proceedings; accordingly the extension of time to apply for review is granted and the merits of the review will be heard separately.
