The appeal is allowed because the sentencing Judge failed to articulate and justify a departure from the ordinary 'halving' approach to converting imprisonment to home detention and failed to give credit for time already served; accordingly the 12 month home detention was set aside and replaced with 2 months home detention to reflect the statutory release calculation and custody already served.

Judge Ingram made an error by failing to account for appellant's approximately two-and-a-half months of pre-sentence custody when converting imprisonment to home detention; that error produced an unjust result and required quashing the six months' home detention and substituting three-and-a-half months' home detention to reflect time served.

The District Court erred by not applying a youth discount and by failing to deduct four and a half months of pre‑sentence custody when converting the sentence to home detention; correcting those errors and applying the agreed discounts and conversions produced a substituted sentence of three months and one week's home detention commencing 17 December 2019.
