The Court found on the balance of probabilities that Mr Morisset authored the original Elwood drawings and G‑Star owns the copyright, the Anniversary jean was a 3‑D reproduction of that design, Jeanswest Australia copied a substantial part to make the Dean Biker jean, and Jeanswest NZ is liable as a secondary infringer because the knowledge/reason to believe of Australian decision makers was properly imputed to the New Zealand importer and retailer; relief granted included declarations, an injunction and nominal damages of NZD 325 plus costs.
