A Corrections Officer employed by a private contractor managing a prison falls within the meaning of an "official" because such employees are "officers" under the Corrections Act exercising powers and functions of the Chief Executive by delegation and therefore are "persons in the service of the Sovereign in right of New Zealand" for the purposes of s99/s105; consequently the s147 dismissal application fails as a properly directed jury could reasonably convict.
