The Court found that a sale of the trust property was expedient under s64, that the defendant's conduct was likely to obstruct sale and depress value, and that the Court's inherent jurisdiction permits ordering eviction to give effect to the sale; accordingly the Court ordered sale, vacant possession by a set date, enforcement by the Sheriff if necessary, allocation of sale proceeds and costs and reimbursement as specified.

On the balance of probabilities the medical evidence did not establish a causal relationship between the 1993 injury and the appellant's ongoing pain and incapacity, therefore ACC was entitled to cease the appellant's entitlements and the appeal is dismissed.
