Because the appeal was abandoned the respondent was entitled to recover costs for wasted steps; applying r 14.5 and categorising the proceedings as category 2, the Court allocated Band B to the first case management conference and other standard steps, Band A to the brief second memorandum and attendance, and awarded costs of $3,582 to the respondent.
