The respondent, as the successful party, is entitled to costs on a Category 2B basis for the steps set out in its memorandum dated 14 August 2020, subject to two specified exceptions: (1) limit costs for written submissions in opposition to the interlocutory application to three days because the interlocutory matter was not separately heard; (2) decline costs for preparation of the case on appeal where no separate case on appeal was filed and the judge relied on the District Court file and material filed in support of the appeal.
