Although CPAA proved defamatory utterances, as a corporate plaintiff it failed to establish pecuniary loss so its substantive claims did not succeed; NZICA as successful party was entitled to costs on a 3B scale but those costs were reduced to 75% because NZICA's conduct (unjustified defences, failure to admit facts and conduct perpetuating disparagement) materially increased costs; CPAA's rejection of the settlement offer was reasonable and did not attract additional adverse costs consequences.
