Because the High Court adjudication of bankruptcy was founded on a District Court default judgment that was set aside, the appeal must be allowed and the adjudication set aside; ancillary relief including release of security for costs and directions for determination of costs follow.

The District Court Rules costs scale does not apply to this case and the Court will not apply the District Court Rules formula to costs for an appellant represented by a non-practising advocate; accordingly the application for entitlement to a costs award under the District Court Rules is dismissed.
