The prior costs order was corrected under the slip rule to award indemnity costs payable from the estate because the proceeding affected the estate fund, the applicant (a beneficiary) was a necessary party to the proceedings to remove trustees, and the applicant had acted reasonably; therefore r 14.6(4)(c) justified indemnity costs payable out of the estate.
