Because the appellant's application to adduce further evidence was dismissed and he abandoned the appeal without disputing the respondent's claim for costs, the court exercised its discretion to award costs to the respondent in the specified sum and ordered the $3,000 security paid into court to be paid out to the respondent and off-set against that award.
