Because the deed lacked an amendment power and beneficiaries were an unascertained class making consent impossible, and because the applicant filed satisfactory affidavit evidence and resolved minor drafting points, the Court was satisfied that approval under s 64A should be granted and ordered approval of the deed of variation and restatement.
