Given the applicant's documented monthly income and fixed outgoings (notably two mortgage obligations) which consume most or all of her income, and that payment would force further indebtedness and substantially impair her ability to litigate, the Registrar's decision was set aside and the hearing fee waived to preserve access to justice.

Appellants failed to demonstrate undue financial hardship in light of their disclosed income and assets and the absence of sufficient supporting documentation; therefore the Deputy Registrar correctly declined to waive the $1,087.50 filing fee and the review application is dismissed.

The Court granted the extension of time because, on balance, the interests of justice required it: overall delay was not excessive, counsel had been recently retained and undertaken to meet the timetable, there was no suggestion of bad faith, substantial sums and first appeal issues were involved, and prejudice to the respondent was minimal; accordingly all issues including the Lotto-proceeds point may proceed and specific procedural orders were imposed.
