On the balance of probabilities the Court found the January 24 2009 accident caused a significant knee injury (lateral meniscal tear) and that any contribution from degenerative change was insignificant; consequently ACC's determinations of 20 May 2010 and 12 August 2010 declining cover and surgery funding were incorrect and were set aside.
