Leave to appeal was dismissed because the applicant failed to establish a question of law; the Court of Appeal's overturning of the High Court deemed decision operated retrospectively so no cover ever existed and without cover there can be no entitlement to weekly compensation; additionally there was no evidence the applicant was an earner at the relevant time.
