The appeal is dismissed because entitlements under the Accident Compensation scheme require cover for the injury and cover for the left leg varicose veins and major depression was not accepted until 2014–2015; there is no legal basis to backdate the 2015 33% WPI assessment to 2011 and clause 63(e) Schedule 1 AI Act means the reassessment takes effect from the next quarter following the 15 September 2015 decision.

The appeal was dismissed because the Court found the issue of whether the right shoulder was a covered injury was outside the scope of the challenged decision to cease weekly compensation; the Corporation had earlier declined shoulder cover and had not made a new primary decision based on later medical reports, so the Court would not decide shoulder cover as part of this appeal and there was insufficient basis to overturn the cessation decision.
