The 2001 Act applies because the relevant assessments commenced after its commencement; the appellant's CoverPlus arrangement with ACC is not an 'accident insurance contract' under Part 7 of the 1998 Act and thus s342 savings and s66 deemed-decision protections do not apply to him; on the rehearing of the evidence the Court was satisfied the appellant was vocationally independent and had not demonstrated deterioration, so the appeal is dismissed.
