The Court dismissed the appeal because the appellant failed to establish, on the balance of probabilities, a causal link between the 1990 ladder fall (accepted cover for a lumbar sprain) and the cervical pathology requiring surgery; absent sufficient medical evidence of causation, ACC's decision to decline funding was correct and is upheld.
