On the balance of probabilities the medical evidence does not establish that the 2007 turpentine exposure caused or materially contributed to a physical brain injury; specialist reports and the Toxicology Panel consistently attributed symptoms to somatoform or psychiatric causes and transient effects, therefore statutory criteria for cover for a gradual process injury are not met and the Corporation's decision to decline cover is upheld.
