Although the appellant suffers a chronic pain disorder that is causally linked to the 1998 back injury, the depression is episodic and driven by multiple life events and pre-existing tendencies; on the balance of probabilities the depression was not suffered "because of" the 1998 physical injury in the required significant and substantial sense, therefore ACC's refusal to cover the mental injury must be upheld.
