The Court concluded the s.250 requirements were satisfied: the debt to Acrow had been paid, there appear to be no other creditors currently, the sole shareholder consents, and the company is solvent with an imminent refinancing; accordingly, it was just and equitable to terminate the liquidation, subject to payment of the liquidators' costs and confirmation thereof.
