Applicant's grounds failed: the Judge's prior contacts were disclosed and did not demonstrate a disqualifying conflict or procedural defect; the applicant had affirmatively presented an insolvency proposal and thereby conveyed he was insolvent; no concrete, post-adjudication change or available funds were shown to pay all creditors; accordingly the court declined to exercise its discretion to annul under s 309(1)(a) or (c).
