The Court ordered inspection by the Australian firm Allens Arthur Robinson because (i) the defendants are entitled to instruct their chosen Australian advisers; (ii) disclosure to Allens would not, on the material before the Court, facilitate a breach of the New Zealand Lawyers and Conveyancers Act because Allens practise in Australia; (iii) there was no real risk of misuse given the similar issues in the Australian and New Zealand proceedings and the undertakings offered by Allens which the Court found adequate and enforceable; and (iv) the discovery regimes are substantially equivalent.
