Because there was a direct and material contradiction between Sharma's affidavits and evidence in Mr Richardson's affidavit suggesting concealment of an interest in the Prescott Street property, credibility was pivotal to the freezing order application and 'special circumstances' under r 7.28 were established; accordingly the court ordered Sharma to attend for cross-examination.
