The court refused to stay the proceeding to arbitration because on the evidence it was immediately demonstrable there was in reality no dispute on the substantive lease and trespass claims; consequently the defendants had no substantial grounds of defence and leave to file a statement of defence was refused; the plaintiff was granted leave to cross-examine the second defendant on the contempt application.
