Mr Tait failed to establish that enforcement of the award would be contrary to New Zealand public policy. The CLWA did not discharge the award; at most it supplemented it and that supplementation does not prevent entry of the award as a judgment; Council's resource consent refusal and planning issues did not meet the high threshold required for the public policy exception and alternative means to comply had not been explored. The award is therefore entered as a judgment and costs are awarded to Botev Trustee Limited.
