The Amended Statement of Claim failed to plead primary facts linking the alleged malicious conduct to identifiable public officers; the claim was in substance institutional against Immigration New Zealand/Crown and thereby barred by the proviso to s6 of the Crown Proceedings Act 1950; accordingly the claim was plainly untenable and properly struck out on review.
