The Court held that the Crown, exercising powers under the Public Works Act 1981, could acquire component parts of interests in unit titled land and subsisting rights (including voting rights) necessary for the public work and therefore did not have to comply with the Unit Titles Act 1972 requirement for unanimous body corporate resolutions to effect transfers; accordingly the PWA modifies the UTA to the extent of inconsistency in this context, and, having nevertheless sought compliance, the Crown was granted relief under s 41 UTA dispensing with the votes of proprietors of Units 1A, 2A and 8…
