- High Court
Judge set a starting point of 3 years' imprisonment, applied a 20% guilty plea discount and additional mitigating discounts (remorse 5%, good character 5%, rehabilitation 5%, cultural factors 5%) aggregated to produce an end sentence equivalent of roughly 21.5 months' imprisonment; because the term was short and eligible for home detention and short prison terms are effectively half-served under Parole Act s86(1), the court imposed 11 months' home detention and disqualified driving for two years.
