The Court found the defendants gave effect to unlawful customer allocation and related arrangements in breach of ss 27 and 30, that the agreed penalties were within the appropriate range having regard to seriousness, duration, seniority, market importance and mitigation (including cooperation and early settlement), applied a 35% discount, and imposed pecuniary penalties of $4.9 million on Mondiale and $65,000 on each of the three individual defendants.
