The goods bore marks identical or similar to the plaintiffs' registered trade mark (s 89(1)), the quantity imported (1800 pairs) showed they were not for private and domestic use, the defendants did not contest the Customs determination or the proceedings, and under s 154(1) the Court was obliged to order one of the statutory disposals and destruction was appropriate, therefore the Court ordered destruction of the goods.
