The Court found, under s56(1) Charitable Trusts Act, that the Scheme was proper and charitable: continuing the original accommodation purpose had become impracticable given modern state care arrangements and lack of sustainable funding, the proposed amended purpose (benefit children from disadvantaged backgrounds) sufficiently matched the trust's charitable object, and authorising sale of all trust property including the house and curtilage was necessary to realise capital to pursue the revised charitable purpose; accordingly the Scheme was approved and orders made to amend purpose and powers…
