The Court settled the scheme under s48 because the repairs to the building's common and private areas were so interconnected that a single managed contract with apportionment of costs (by Maltbys) was necessary and appropriate to ensure proper reinstatement and protect the value of all units; the Court therefore had power to order owners to contribute as part of a s48 scheme and did so in the form annexed to the supporting affidavit.
