On the parties' admissions and evidence, the Court declared that Moola breached s 9C of the CCCFA in four specified ways (failure to make reasonable inquiries about requirements/objectives and ability to pay without substantial hardship; failure to exercise care in advertising; failure to treat borrowers reasonably and ethically in default contact), and granted declaratory relief by consent without a hearing.
