The Authority is not entitled to costs because the appeal was a statutory appeal confined to questions of law under s 64 of the Electricity Industry Act 2010 and was not a judicial review; decision‑makers should not normally participate substantively on appeal and the Authority's submissions were of interest but not essential, so there is no reason to depart from the usual course of refusing costs to the Authority.
