The District Court judge did not err in refusing an adjournment and proceeding in the appellant's absence because the appellant's failure to appear was inexcusable, he took no steps to be trial-ready, it would have been unfair to the respondent to delay further, and no arguable defence of truth or procedural basis under the Protected Disclosures Act was established; accordingly the appeal is dismissed.
