The Court found an arguable case on the contractual and data‑ownership issues and that the balance of convenience favored the plaintiffs because imminent mating posed real risk of irremediable harm to breeding integrity, flock value and reputation; defendant's losses were compensable by damages and plaintiffs offered undertakings; accordingly a limited interim order compelling defendant to provide SGA data to the plaintiffs' nominated breeding consultant for preparation and implementation of a mating plan was justified and was ordered subject to preservation/destroy/return conditions.
