Leave to appeal was refused because the alleged errors were not seriously arguable errors of law: the arbitrator applied the balance of probabilities, was entitled to infer authority from the parties' course of dealing and documentary records, to treat collection/site delivery practice as contractually accepted and to interpret the price clause in light of pricing and invoicing procedures; the costs award was within the arbitrator's discretionary power.
