The statutory demand was set aside because the company produced accountant schedules showing specific subsequent transactions that, when properly accounted for, gave rise to a genuine and substantial dispute as to whether Mr Coghlan remained a creditor; the demand was not properly proved at the outset and the debt may not have been due and payable when the demand was issued.
