The interim injunction was dismissed because the misdescriptions in the Notice were immaterial and did not prejudice the applicant, the applicant had received and participated in the process, and s296 RMA precludes High Court injunctive/judicial review relief where the RMA provides for determination by a Commissioner and appeal to the Environment Court; the Commissioner should determine validity and may modify the requirement under s168A(4).
