The Court accepted the parties' negotiated penalty of NZD 7.5 million as within the proper range after determining a starting point of NZD 9.0–9.75 million based on seriousness, duration, market impact and Air NZ's size, and then applying an approximately 20% reduction for mitigation (admissions, cooperation, compliance programmes, clean record); costs of NZD 259,079.18 and a NZD 300,000 contribution to investigation costs were ordered.
